Divorcees qualifying for Tier 1 and Tier 2 will be able to take advantage of filing a Restricted Application for divorced spousal benefits only to allow their own retirement benefit to accrue Delayed Retirement Credits. The exception to this rule is for those that qualify under Tier 3 of the new law changes.
In order to qualify for Divorced Spousal Benefits:
- Must be single.
- Must have been married for ten (10 years).
- Must be divorced for two (2) years.
- Must be at least age 62.
- Former spouse must be at least age 62.
If you meet all of the above rules and regulations and qualifications, this benefit will not affect your former spouse’s benefit amount.
