Divorcees qualifying for Tier 1 and Tier 2 will be able to take advantage of filing a Restricted Application for divorced spousal benefits only to allow their own retirement benefit to accrue Delayed Retirement Credits. The exception to this rule is for those that qualify under Tier 3 of the new law changes.

In order to qualify for Divorced Spousal Benefits:

  1. Must be single.
  2. Must have been married for ten (10 years).
  3. Must be divorced for two (2) years.
  4. Must be at least age 62.
  5. Former spouse must be at least age 62.

If you meet all of the above rules and regulations and qualifications, this benefit will not affect your former spouse’s benefit amount.
